Case Summary
Fowler | Helsel | Vogt secured a policy limits settlement of $6,000,000 on behalf of our clients. The settlement stemmed from a motor vehicle collision that resulted in the death of two people and severe injuries and significant medical treatment for the other two occupants.
Facts of the Case
The crash happened when a pickup truck drove at a high rate of speed through the fog on a state highway and slammed into a vehicle carrying four people who were attempting to make a lawful left hand turn from the median and off of the freeway. Due to the excessive speed of the Defendant in visibility blinding conditions, the Defendant did not see our clients’ vehicle completing their turn off of the highway.
Treatment
The two injured parties who survived the crash underwent substantial medical treatment including treatment for a traumatic brain injury, physical therapy, pain injections, PTSD, and imaging.
Legal Strategy
Our legal team built a compelling case by taking the deposition of the investigating officer who had originally placed the entire fault of the collision on our clients. After using expert witnesses to conduct an electronic data recorder download of Defendant’s vehicle and confronting the officer with the actual and excessive speedof Defendant, the officer reversed his conclusion and reallocating the entire fault onto Defendant. Shortly thereafter, the case settled for the full policy limits of $6 millioin dollars.
Settlement Terms
Fowler | Helsel | Vogt successfully negotiated payment of the full $6 million dollar policy limits from the Defendant compensating our clients for their medical bills and pain and suffering and compensating the families who lost their loved ones in the collision.
Conclusion
The successful resolution of this case exemplifies the Fowler | Helsel | Vogt quest for justice even when the blame is wrongfully placed on the victims of a collision. Fowler | Helsel | Vogt takes on the hard cases and finds justice, no matter who hard it tries to hide.
