Attorneys Helsel and Vogt represented David Castillo, an HVAC worker who was hired to work on the defendant's property, a complex of five two-story apartment buildings. While repairing an air conditioning unit, the ladder affixed to the side of the building that Castillo was using broke away from its fastenings, causing him to fall approximately 16 feet to the ground, where he sustained serious injury.
The defendant initially asserted that they held no responsibility for this accident, but Attorneys Helsel and Vogt disagreed. Outside of court, they were able to effectively assert the defendant's "duty to exercise ordinary care" under California Civic Code Section 1714(a). Simply put, property owners are obligated to provide safe conditions to all those who are welcomed or allowed on the property. In Mr. Castillo's case, he was allowed onto the property as a licensee who was exposed to a dangerous condition should have reasonably been addressed by the property owner before someone was harmed.
Ultimately, a settlement was reached:
- $45,647 for past medical expenses
- $94,839 for future medical expenses
- $1,859,515 for pain and suffering
